My Expert Service

My work is to explain intellectual property law, make it accessible and to help determine if and when intellectual property law should be used. I work on both general and specific issues around intellectual property and indigenous/traditional knowledge, cultural heritage and knowledge protection. For example, I can answer all kinds of general questions about intellectual property – historical, international and theoretical perspectives about the operation of these laws; questions about creative commons, the public domain and orphan works; options for protecting and defending artists rights; how to identify and protect indigenous people’s rights in cultural knowledge; what the relevant laws for archives/museums/libraries and/or cultural institutions around access and ownership of collections are. Specifically I help explain complex legal concepts so that people with non-legal training can make informed decisions about what action is needed. This may include knowing exactly what questions to ask your lawyer before you get there, or what kinds of clauses you should have in a contract or agreement. I have extensive experience in providing guidance around legal and other rights that exist in photographs, films, sound recordings and manuscripts found in archives, libraries and cultural institutions. I can help determine who has legal rights when digitizing works and creating digital archives and databases. I can also: help draft, write and develop research agreements between researchers and/or artists and local or indigenous communities; help explain or interpret a contract; and, help create benefit-sharing agreements between parties that are practical, easy to understand and create meaningful and equitable working relationships.

Experience & Qualifications

I have worked on IP and Indigenous/traditional knowledge issues for 9 years in Australia, Indonesia and the US in local communities, regional organisations and national institutions. These include the Australian Institute for Aboriginal and Torres Strait Islander Studies and the Smithsonian Institution. I am an Expert Consultant for the World Intellectual Property Organisation. Here I am working on a series of documents that will provide technical assistance for artists, researchers, Indigenous peoples and archives and museums. I have been awarded various fellowships including a Rockefeller Foundation Fellowship. I have numerous publications and my book, Law, Knowledge, Culture (2009) is published by Edward Elgar Press and currently available on Amazon.
