Public employees (bargaining unit and non-bargaining unit employees at the county, state, and federal level) facing suspension, removal, demotion, or any type of disciplinary or adverse action have tough choices to make in a short amount of time and under a great deal of stress. Therefore, employees require accurate and timely information to make informed decisions as to how to respond and which appeal route to select (public employees often have multiple appeal routes and are entitled to due process hearings). In the vast majority of cases, public unions, which are managed by untrained volunteers, are not technically proficient in providing accurate and sufficient information to the employee nor do they have the resources to hire professionals. In most cases, the union representative has never received any training in representing employees. Compounding the lack of union professionals is the fact that only a handful of attorneys are familiar with public, and particularly, federal personnel laws, they are most likely not located near the employee, and retainer fees normally start at $2,500 to $5,000 with a simple consultation concerning a proposed removal (firing) costing in excess of $500.

Don't let your union or attorney misinform you. Anyone can represent or otherwise assist you in a public personnel matter. Most collective bargaining agreements provide this option and federal law requires that federal unions allow other representatives aside from the union or an attorney. Since this is an area of administrative practice, you do not need an attorney to represent you before the agency, MSPB, FLRA, EEOC, or an arbitrator.

Experience & Qualifications

I have fifteen years of practical experience and strong academic credentials in representing both the federal employee and agency. Previously, I was union President of one of the largest A.F.G.E. local unions in the nation, employing very aggressive and forward thinking representational techniques in defense of federal law enforcement officers. Currently, I provide consultative services as a Labor Management Relations Specialist and Suitability Adjudicator for a large federal agency with a multi bargaining unit and very large workforce.

My experience representing both unions and federal agencies focused on Title 5, Title 38, Hybrid, Federal Law Enforcement, and Federal Healthcare related personnel matters. I have extensive experience working very closely with attorneys in all areas of administrative and civil litigation related to federal personnel matters and have prepared and/or represented cases before the Federal Labor Relations Authority, Merit Systems Protection Board, arbitration, Equal Employment Opportunity Commission, and Responsible Management Officials (RMO) at federal agencies. Prior experience includes congressional lobbying on personnel and labor matters to include preparation of congressional testimony. My formal job related training includes mediator certification, Administrative Investigations Boards (AIB), suitability and background investigations (security related matters), Title 38 actions, grievance training, negotiations, and privacy.
