Do the words “Will” or “Trust” or “Estate Planning,” make you think about what you may get or what you will leave to others? Do you think Wills or Trusts are only for people who have lots of money? Does the word “probate” scare or confuse you?
Wills and Trusts are not merely a means to ensure your wishes are carried out after you die. They are useful tools you might even use today. Yes, you can use a Trust to reduce estate taxes. But, you could also use a trust to protect your existing or future assets from creditors, ensure proper investment and management of assets, and, under certain circumstances, even reduce your income taxes.
If you speak with anyone about an estate plan, make sure you understand whether you are getting legal or financial advice. Many firms can create your Will, Trust or other Estate Planning document. But when they start giving you investment advice, or ask you to invest your money with them, or make other statements that trigger your sense of alarm, you should be at least slightly wary. Why?
Many financial advisors tend to only recommend products or strategies for which they get a commission or other form of compensation. Please know that there is no reason why you need to invest in the recommendations given by those who created your documents. Even today, several States are investigating “Investment Advisors” who have pocketed huge commissions at the expense of their “clients.”
